These Terms of Use apply to the public websites and pages operated by Shop Makers in the United States, listed in Section 1.

1. Who we are and what these terms cover

The United States sites are operated by Shop Makers US Holdings Inc., a Delaware corporation, and its subsidiary Shop Makers Pike LLC, which operates the Shop Makers store at 106 Pike St, Seattle, WA 98101 (together, "Shop Makers", "we", "us").

These terms cover:

  • www.shopmakers.us (the "Sites");

  • the public pages of MakersPOS at pos.shopmakers.us, such as the sign-in page, password reset pages, gift card balance check and unsubscribe pages;

  • forms we link to from the Sites, such as vendor applications, support requests and careers forms;

  • email newsletters you sign up for through the Sites.

By using the Sites you agree to these terms. If you do not agree, please do not use the Sites.

Vendors. If you are a maker who rents space in a Shop Makers store, your membership is governed by the Vendor Terms of Service you accepted when you joined, together with the policies in the Shop Makers Help Centre. If these Terms of Use and the Vendor Terms of Service conflict, the Vendor Terms of Service prevail for anything to do with your membership, your goods, your fees or your payouts. Signed-in use of MakersPOS is governed by the Vendor Terms of Service, not by this document.

Privacy. How we collect and use personal information is described in our Privacy Policy at /privacy-policy. The Privacy Policy forms part of these terms.

2. Eligibility

You must be at least the age of majority in your state to submit a vendor application, purchase a gift card or sign up for our newsletter. If you are younger, you may browse the Sites but please do not send us personal information. If you use the Sites on behalf of a business, you confirm you have authority to bind that business.

3. Acceptable use

You agree not to:

  • use the Sites for any unlawful purpose or in breach of these terms;

  • attempt to gain unauthorised access to MakersPOS, any account, or any system connected to the Sites;

  • scrape, harvest or collect information about our makers, customers or staff, including maker names, product photos and store contact details, for any commercial purpose;

  • upload or transmit malicious code, or interfere with the operation of the Sites;

  • impersonate any person or misrepresent your relationship with Shop Makers or any maker;

  • copy or reuse content from the Sites except as allowed in Section 6.

We may suspend or block access to the Sites for anyone we reasonably believe has breached this section.

4. Newsletters, forms and communications

Newsletter. When you sign up for our newsletter you are asking us to send you commercial electronic messages about Shop Makers stores, events, promotions and our makers. You can unsubscribe at any time using the link in any message or by emailing privacy@shopmakers.us. We send these messages in accordance with the CAN-SPAM Act.

Forms. Vendor applications, support requests and careers submissions are collected through forms hosted by Paperform and, in some cases, Squarespace. Information you give us in a form must be accurate. Submitting a vendor application does not create a membership; a membership begins only when you accept the Vendor Terms of Service and your application is approved.

Careers. Job postings on the Sites are for information. Submitting an application does not create an offer of employment.

5. Gift cards

Shop Makers gift cards may be purchased in store or through the Sites. Online gift card orders are processed by Squarespace and delivered by email. Gift cards are governed by the Shop Makers Gift Card Terms at /gift-card-terms, which form part of these terms. Refunds and returns of goods bought in store are governed by our Return Policy at /return-policy.

6. Intellectual property

Our content. The Sites, including text, logos, the Shop Makers and MakersPOS names and marks, page designs, photographs taken by or for Shop Makers, and software, are owned by Shop Makers or our licensors. You may view and print pages for your personal, non-commercial use. Any other copying, republication or commercial use needs our prior written permission.

Maker content. Product photographs, brand names and descriptions of makers' goods shown on the Sites belong to the individual makers and are displayed under licence from them. Shop Makers' goods, names and images may not be copied, reproduced or used to suggest an association with Shop Makers without the maker's permission and ours.

Feedback. If you send us ideas or suggestions about the Sites or our stores, you agree we may use them without any obligation to you.

7. Your submissions

If you post reviews, testimonials, photos or other content to the Sites, to our forms or to our social media accounts, you confirm that you own the content or have permission to share it, and that it does not infringe anyone's rights or contain anything unlawful. You give Shop Makers a non-exclusive, royalty-free, worldwide licence to reproduce and display that content in connection with promoting Shop Makers stores and our makers. You may ask us to remove your content by emailing privacy@shopmakers.us, and we will do so where reasonably practical.

8. Third-party services and links

The Sites use or link to services run by other companies, including Stripe (payments and vendor payouts), Paperform (forms), Squarespace (website hosting and online gift card orders), Google Maps (store directions), and social media platforms such as Instagram, Facebook and TikTok. Those services have their own terms and privacy policies. We do not control them and are not responsible for their content, availability or practices. A link from the Sites is not an endorsement.

9. Disclaimers

The Sites are provided "as is" and "as available". We aim to keep information such as store hours, locations, product availability and maker listings accurate, but we do not promise that the Sites will be error-free, uninterrupted or free of viruses. Product photographs are illustrative; handmade goods vary and the item in store may differ from the photograph. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, in relation to the Sites.

This section does not apply to goods you buy in a Shop Makers store. Your rights relating to purchased goods are governed by our Return Policy and by applicable law.

10. Limitation of liability

To the fullest extent permitted by law, Shop Makers, its affiliated companies, and their directors, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, data or goodwill, arising from your use of or inability to use the Sites. Our total liability to you for all claims relating to the Sites will not exceed the greater of the amount you paid us through the Sites in the 12 months before the claim and USD $100.

Consumer rights carve-out. Nothing in these terms limits or excludes rights you have under applicable consumer protection law that cannot be limited or excluded by agreement. This includes rights under the Washington Consumer Protection Act and any other state law that applies to you.

11. Indemnity

If you are using the Sites for a business purpose, you agree to indemnify Shop Makers against claims, losses and reasonable legal costs arising from your breach of these terms or your misuse of the Sites. This section does not apply to individuals using the Sites for personal purposes.

12. Changes to the Sites and these terms

We may change, suspend or discontinue any part of the Sites at any time. We may update these terms by posting a revised version with a new effective date. Material changes will be highlighted on the Sites for at least 30 days. Your continued use of the Sites after the effective date means you accept the revised terms. Changes to the Vendor Terms of Service are notified separately under that agreement.

13. Governing law and disputes

These terms are governed by the laws of the State of Washington, without regard to its conflict of laws rules. You agree that the state and federal courts located in King County, Washington have exclusive jurisdiction over any dispute about the Sites, except that if you are a consumer, nothing prevents you from bringing a claim in a court of competent jurisdiction where you live if applicable law gives you that right.

Before starting any legal proceeding, please contact us so we can try to resolve the issue informally.

14. General

If any part of these terms is found unenforceable, the rest remains in effect. These terms, the Privacy Policy, the Gift Card Terms and the Return Policy are the whole agreement between you and Shop Makers about your use of the Sites. Our failure to enforce a term is not a waiver of it. You may not assign these terms; we may assign them to an affiliate or a successor to our business.
